《宁波市海上丝绸之路史迹保护办法》审议正式通过

“Measures for the Protection of Historic Sites Along the Maritime Silk Road in Ningbo City”Reviewed and Formally Approved

11月22日下午，《宁波市海上丝绸之路史迹保护办法》（以下简称《办法》）经宁波市人民政府第90次常务会议审议正式通过。

On the afternoon of 22^nd November,  the“Measures for the Protection of Historic Sites Along the Maritime Silk Road in Ningbo City”(“Measures”) was reviewed and officially approved by the 90^th executive meeting of Ningbo Municipal Government.

根据国务院相关协调会议精神，国家文物局确定“海上丝绸之路”作为2018年度我国世界文化遗产申报项目，由泉州牵头，联合广州、宁波、南京等城市共同实施推进。目前，宁波市海上丝绸之路4处史迹点（永丰库遗址、上林湖越窑遗址、保国寺、天童寺）已经列入“中国世界文化遗产预备名单”，海上丝绸之路申遗工作取得阶段性成果。根据世界文化遗产申报的法定要求和宁波市海上丝绸之路史迹保护管理工作的现实需要，需立法明确宁波海上丝绸之路史迹的保护原则和管理机制，规范保护管理与展示利用。

In accordance with the spirit of the relevant coordination meeting of the State Council, the State Administration of Cultural Heritage decided that the "Maritime Silk Road" was the project of the country’s declaration for the worldcultural heritages in 2018, which will be led by Quanzhou and jointly implemented and promoted by Guangzhou, Ningbo, Nanjing and other cities. At present, 4 historical sites including Yongfengku Ruin, Yue Kiln Site of the Shanglin Lake, Baoguo Temple, Tiantong Temple along the Maritime Silk Road of Ningbo City has been included in the "China World Cultural Heritage Preparatory List", suggesting the declaration work has achieved initial results. According to the legal requirements of the world cultural heritage declaration and the actual needs of Ningbo Maritime Silk Road historical site protection and management, it is necessary to establish the law to make clear the protection principle and management mechanism of Ningbo Maritime Silk Road historic sites and standardize the protection management, display and utilization.

根据宁波市法律规章制定的要求，宁波市海丝办成立了专门的立法起草小组，在宁波市法制办的指导和参与下，于今年7月初赴广州海丝申遗办、贵州遵义海龙屯世界遗产管委会等地调研，于8月和9月赴遗产点调研并在遗产点所在（市）区召开当地相关部门调研会，在此基础上撰写并不断完善《办法》草案，经过广泛征求各相关单位及社会公众意见，反复修改后，正式提交市政府。

According to the requirements of laws and regulations of Ningbo City,Ningbo Maritime Silk Road Office has set up a special legislative drafting group. Under the guidance and participation of Ningbo City Legislative Affairs Office, the group went to Guangzhou Maritime Silk Road Heritage Declaration Office and the World Heritage Administration Committee of the Dragon Village Site ofZunyi, Guizhou in early July this year to conduct researches. Afterwards, they investigated the heritage sites in August and September and held the research meetings of local relevant departments in the district where the heritage sites were located. On this basis, they drafted and perfected the draft of the“Measures”which was formally submitted to the municipal government after a broad consultations from the relevant units and the public and repeated revisions.

   据悉，《办法》共二十六条，主要从适用范围、政府和部门职责、海丝史迹保护规划的制定、保护范围的禁止要求、管理责任人的确定及义务、史迹利用以及法律责任等方面进行了规定。

    It is reported that the "Measures" has 26 articles mainly including the scope of application, government and departmental responsibilities, the protection plan of historical sites along the Maritime Silk Road, the prohibition requirements ofthe protection scope, the determination and obligations of the person in charge of the management, historical utilization and legal responsibilities.
